Terms of use

1. The agreement

These terms govern your use of the LangBuddy mobile app and this website, both provided by zhware (“we”, “us”). By installing or using the app you accept them. If you do not accept them, do not use the app.

Where the app is obtained through Apple’s App Store, Apple’s Licensed Application End User License Agreement also applies, and prevails over these terms wherever the two conflict. Apple and Google are not parties to these terms and have no obligation to provide support for the app.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own language learning. You may not sell, rent or sublicense it, and you may not reverse engineer, decompile or attempt to derive its source code except where that restriction is prohibited by law.

3. Your content stays yours

The words you capture, the notes and tags you add and everything derived from them are yours. They are stored on your device; we neither receive nor claim any rights in them. You are responsible for what you capture, including respecting the copyright of anything you copy from another source.

4. Third-party AI providers

The app can optionally send text to an AI provider you choose, using an API key from your own account with that provider. When you do so:

Machine translation is imperfect. Translations, explanations, example sentences and generated quizzes may be wrong, and must not be relied on where accuracy matters — in medical, legal, financial or safety contexts, or in any professional translation.

5. Backups are your responsibility

The app writes local backups on the device, but those are lost with the device. Export your vocabulary to a file you keep yourself if it matters to you. We cannot recover data for you, because we never have it.

6. No warranty

The app is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any defect will be corrected.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for lost data, lost profits or costs charged to you by a third-party AI provider, arising from your use of the app. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

8. Changes and availability

We may update the app, change its features, or stop distributing it. We may revise these terms; the current version is always the one on this page, with its date at the top. Continuing to use the app after a change means you accept the revised terms.

9. Governing law

These terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. If you are a consumer, you keep the protection of any mandatory law of the country where you live.
